Abstract:
The chapter discusses the possible impact of the rapidly emerging social or social and solidarity economy laws on the legal structure of cooperatives as laid down in the respective laws on cooperatives. In general, these laws regulate the promotion of specified legal entities and/or entities that fulfill organizational criteria and pursue public policy objectives through specified activities. Among these legal entities are, or upon application may be, cooperatives. This mixing of organizational requirements, objectives and activities often leads to confusion. On the one hand, the social or social and solidarity economy laws seem to leave the legal structure of cooperatives untouched; on the other hand, the organizational criteria that these laws specify for those cooperatives which are not per se eligible for promotional measures may have an impact on their structure. The objective of this chapter is to explore whether and to what extent this is the case.
