Abstract:
This chapter examines developments in the digital economy in relation to the use of technology and digitalisation in international commercial arbitration (ICA). It considers the need to reconcile challenges in the adaptation of ICA to new technologies, such as in relation to benefits and threats of blockchain technology and smart contracts to confidential proceedings. It stresses that ICA will continue to be impacted by the digital revolution. It will render ICA speedier and more cost-effective, but will also render it vulnerable to deficiencies, such as the inefficient and disruptive use of blockchain technologies and other technological innovations. The chapter examines the risks and benefits arising from such innovations to the protection of confidentiality in arbitration proceedings.
