The New Development Philosophy: inspiration for the WTO reform on industrial subsidy rules

Abstract:
Since its inception, the World Trade Organization (WTO) has been charged with a development agenda. The 30-year-old rules, however, had their limitations and became increasingly inadequate to address the newly emerged developmental challenges like climate change, global pandemics, economic disparities, and geopolitical tensions. The new wave of state interventionist measures, like industrial subsidies, once again invokes the question of the extent to which the WTO rules should allow these measures in the name of development. Through a comparative analysis of China's New Development Philosophy and other theories of development, this chapter furthers the discussion on the reform of the WTO industrial subsidy rules in light of the evolving concept of “development.” In light of this discussion, it proposes that the WTO subsidy rules should incorporate two new categories of non-actionable subsidies—namely climate change subsidies and development-supporting subsidies—to strengthen the developmental dimension of the WTO rules.
