Abstract:
This chapter focuses on attorneys’ decision-making habits, styles, and patterns and clients’ interactions with their attorneys. It describes the dynamics and assesses the quality of decision making in civil and criminal cases, shows how attorneys’ decision-making biases, norms, and constraints impair decision-making, and illuminates oversights and errors in joint decision making by attorneys and clients.
