Abstract: The decision-making biases, propensities, and limitations of judges, arbitrators, and mediators are explored in this chapter. The effects of judges’ personal backgrounds, parties’ gender and race, and extrinsic factors like re-election timing, workloads, and meal breaks also are examined.
