Abstract:
Chapter 15 looks forward, suggesting ways to adapt to rapid change with simpler, balanced documents, adaptation or replacement of familiar provisions first crafted for ITO, and application of lessons learned during the coronavirus pandemic about force majeure events, prolonged remote operations, and negotiation by videoconference. Future swings in the business cycle may bring renewed attention to lessons learned during the Great Recession and financial crisis of 2007–2009 about renegotiation and troubled or even insolvent companies.
