The encumbrance of intermediated securities in Switzerland

Abstract:
The Swiss legal system does not have a history of non-possessory security rights such as floating charges. However, with the codification of intermediated securities in the Federal Act on Intermediated Securities (FISA) in 2010, a new type of asset was introduced. Based on the FISA, intermediated securities may be encumbered with security rights which to some extent resemble floating charges and serve similar purposes. This chapter analyses the encumbrance of intermediated securities under Swiss Law and compares and contrasts it to floating charges under English law.
