Abstract:
Chapter 10 elaborates on how states in general, and the United States in particular, regulate business transactions extraterritorially. After describing the basic principles of prescriptive jurisdiction, it examines multiple contexts in which by statute or judicial construction U.S. laws have been interpreted to apply beyond U.S. borders. It begins with U.S. antidiscrimination in employment law and its application to employment outside the United States. It then discusses the reach of U.S. antitrust (competition) laws and its limitation through statutes intended to confine enforcement to activities affecting U.S. markets. It then turns to extraterritorial enforcement of intellectual property laws, primarily in the United States, but with some attention to foreign approaches. It concludes with a discussion of extraterritoriality in securities regulation.
