Chapter 2 in Introduction to International Business Transactions, 2024, pp 29-100 from Edward Elgar Publishing
Abstract:
Chapter 2 introduces the major international treaties that structure the regulation of international business law. It provides a brief history of the world trading system and the arguments for international trade. It discusses the World Trade Organization (WTO) Agreements and their major disciplines, including tariff bindings, nondiscrimination, and the prohibition on import quotas. It also introduces some of the other forms of trade harmonization in the treaties, as well as the exceptions of Articles XX and XI. It briefly discusses the WTO side agreements, as well as the WTO dispute settlement system. It also explains the concept of foreign direct investment and the general provisions and challenges of bilateral investment treaties (BITs). It discusses the protections afforded by the typical BIT and how these protections have been interpreted by international tribunals.
