The impact of human rights on international peace agreements

Abstract: This chapter provides a state of the art of literature regarding the nexus of human rights and peace mediation and the integration of human rights in peace agreements. It explores the centrality of human rights to peace, from ancient times to the UN Charter and contemporary mediation efforts, and highlights the indivisibility of law and politics in how human rights standards shape international peace agreements. In this regard, whether parties to conflict agree on the nature and origin of the conflict, how claims of the right to self-determination and minority rights play out, and the degree of international pressure and support for human rights in peace negotiations feature among the determining factors identified by leading authors. The chapter concludes by soliciting further research, including on the gender dimension in peacemaking, to give a more prominent role in theory and practice to the positive role that human rights play in international peace agreements.
