Abstract:
This chapter provides an analysis of two main elements of the competence structure, that is mixed agreements and the duty of cooperation. The Treaty of Lisbon has removed shared competence for almost all trade agreements. The only remaining areas of shared competence are those relating to non-trade-related intellectual property rights and issues linked to transport policy. It is therefore justified to provide an analysis of mixed agreements in the broader sense to EU trade policy after the Treaty of Lisbon.
