Abstract:
In this chapter, attention shall be paid, inter alia, to the Commission’s competence in commercial policy as defined by the Treaties and the Court of Justice of the European Union (CJEU). According to Articles 218(3) TFEU and 101 Euratom, international treaty negotiations with respect to matters involving an element of EU competence, should be conducted a priori by the Commission, namely the EU Trade Commissioner, on behalf of the European Union, on the basis of a mandate agreed by the EU Council.
