ASEAN and the development of ASEAN competition law

Abstract:
The chapter charts the establishment of ASEAN, which has grown from humble beginnings to a significant regional political, security and economic organisation. The ASEAN Member States (AMS) agreed to establish an ASEAN Economic Community, which was the impetus for national competition laws in all the ten AMS. As some of the newest competition regimes in the world, many of the countries looked to other jurisdictions for their design. Many are heavily influenced by the competition laws of the European Union, the United States, the United Kingdom, Australia and other countries. The chapter also describes the development of ASEAN regional institutions, including the ASEAN Experts Group on competition, which promotes information exchange, experience and cooperation on competition policy. It also highlights several ASEAN competition policy documents which provide the focus for regional co-operation, while others educate and support business and ASEAN competition agencies in their understanding of competition law.
