Abstract:
The chapter examines the general exemptions from the competition law in each of the ASEAN Member States (AMS). The chapter discusses the exemptions available for specific agreements and sectors, for services of general economic interest, for compliance with legal obligations and international agreements, on the grounds of public policy or for goods and services regulated by other sector competition laws. The chapter discusses the scope of provisions in some AMS which provide for the making of block exemptions for categories of agreement. The chapter examines exemptions in some AMS which provide for anti-competitive agreements or abusive conduct based on significant countervailing benefits, generally in the form of efficiencies, such as contributing to or improving the production or distribution of goods and services, or promoting technical or economic progress. The chapter also discusses the procedure for seeking exemptions and the process in some AMS which enables their competition regulator to examine an agreement or conduct for its compliance with the competition law, much like an advisory opinion.
