Legal informatics, computer ethics and artificial intelligence

Giovanni Ziccardi

Chapter 3 in Legal Informatics, 2025, pp 103-161 from Edward Elgar Publishing

Abstract: Abstract: Artificial intelligence has brought both opportunities and ethical dilemmas to legal informatics. This chapter examines the ethical frameworks for AI, including the European Union's Ethical Guidelines for Trustworthy AI, the OECD Principles on AI and UNESCO's 2021 Recommendations. It examines AI-related discrimination, particularly in legal decision-making systems, and discusses cases such as COMPAS, which revealed bias in algorithmic sentencing. The chapter also addresses ethical concerns in IT, including gender discrimination, military applications and AI-driven disinformation. Through an analysis of legal expert systems, robo-judges and decision-support software, it highlights the need for ethical considerations in legal AI applications, and proposes regulatory frameworks to ensure fairness and transparency.
