Chapter 4 in Legal Informatics, 2025, pp 162-226 from Edward Elgar Publishing
Abstract:
Abstract: Cybersecurity has become a fundamental concern for legal professionals as cyber threats increasingly target sensitive legal data. This chapter examines the competencies required to mitigate cyber risks, including knowledge of phishing, ransomware and malware threats. It also reviews cybersecurity regulations such as the GDPR, the DORA Regulation and the NIS 2 Directive. The chapter also explores risk analysis methodologies, including data protection impact assessments and fundamental rights impact assessments, emphasizing their relevance in legal practice. It also highlights best practices for cybersecurity in law firms and legal institutions, including the role of legal professionals as data protection officers. By analysing national cybersecurity guidelines, such as those of the UK's National Cyber Security Centre and Australia's LPLC, the chapter provides a comprehensive overview of cybersecurity best practices in the legal sector.
