Abstract: This chapter will consider the scope of legal frameworks in health and social care in responding to intersectionality. I will review the wider international debates on the scope of legal frameworks that are moving towards the concept of dual discrimination. I will also explore the role of policy and practice guidance which might help frame a better navigation of practice issues and to mitigate for those with lived experience. I will draw on examples of case studies to illustrate these complexities, specifically in two areas: gender identity and domestic violence and religious belief and sexual identity. Throughout the chapter, the argument is made that the scope to apply intersectionality when working with statutory frameworks in adult social care requires novel and substantive engagement with complex multi-dimensional and interdisciplinary approaches, values, ethics, and active deconstruction of practice that is categorical or homogenising.
