Animal rights and the rights of nature: between law and politics

Abstract: With the progress of public morality and recognition of the obvious negative consequences of the Anthropocene, the need to limit the human exploitation of animals and nature became increasingly apparent. The tables have turned from the traditional anthropocentric stance, and ideologies have been employed to justify or make more effective – first, environmental law and welfare protection, and then the protection of animal rights and the rights of nature. This chapter argues that despite the shared rationale behind animal rights and the rights of nature as protecting the fundamental interests of nonhumans, they are distinct concepts. It compares them in terms of their subject, legal structure, and political foundations. The main differences, however, lie not in their subject or substance, but in the level of their success – and this is due to profoundly political interpretations, not to the concepts themselves.
