Towards animal flourishing through international law

Abstract: This contribution examines the legal status of animals as far as determined by international law (commodity, natural resource, protected species, and res omnium). It describes the relevant work of two international organisations whose mandates encompass the promotion of animal welfare, namely the World Organisation for Animal Health and the European Union. It then surveys two fields of international law that stabilise animal suffering incidentally, either through scale effects and commodification (international trade law) or through complete neglect (the international law of armed conflict). The chapter ends by proposing pathways for a further development of international law in favour of animal flourishing, while avoiding legal and cultural imperialism, through international customary law, general principles, treaties, and institution-building.
