Article 25: Powers of supervisory authorities
Martijn Scheltema
Chapter 24 in Sustainable Business in Europe, 2026, pp 322-338 from Edward Elgar Publishing
Abstract:
The Article relates to the powers of the supervisory authorities in the Member States supervising the CSDDD. Most of these powers are common in directives, but this is less true for the power to order remedies to affected stakeholders. The commentary assesses how supervision could be shaped considering the limited budgets and capacity of supervisors. It suggests introducing best practices-oriented supervision and explains how this can be enforced in practice.
