Abstract:
This book offers a comprehensive exploration of the complex relationship between Intellectual Property (IP) law and cannabis, highlighting the difficulty of adapting legal frameworks to such a multifaceted product. Cannabis embodies various roles, from a traditional cultural symbol and religious sacrament to a therapeutic agent and commercial good, making its interaction with IP law highly complicated. Contributors discuss how IP protections, such as trademarks, patents, and copyright, often struggle to apply consistently to cannabis. For example, while patents can protect cannabis-based innovations, trademarks are frequently denied based on morality clauses, and the use of cannabis in connection with copyrighted works can raise reputational concerns for artists. A critical argument presented is the need to protect cannabis's cultural and national identity, particularly in Jamaica, where it symbolises anti-colonial struggles and cultural pride. The book emphasises that legal tools like Geographical Indications and Collective Marks could help preserve this heritage and prevent the trivialisation of cannabis, particularly as it relates to Jamaican culture. Overall, the book illustrates the challenges of harmonising cannabis laws globally while advocating for a balance between innovation and tradition.
