Packaging of cannabis: a regulatory overview

Abstract:
As countries steadily legalise the use of narcotics like cannabis, such decriminalisation also necessitates countermeasures to discourage the use of addictive substances. A popular choice for minimising the appeal of cannabis and encouraging informed choices is to make the packaging more neutral via the introduction of warning and labelling requirements, which is the central focus of this chapter. Packaging-related rules have thus been passed that impact cannabis manufacturers and distributors by restricting their ability to use brands, copyrighted works, and other eye-catching elements on the packaging. At the same time, any challenge against these measures, including under intellectual property laws, is likely to be futile due to the health risks of consuming such products, which can act as a reasonable ground to restrict the ability of businesses in this field to use said elements on the pack.
