IXPs and the telecommunications regulator: comparing approaches from Russia, Brazil, and the US

Abstract: This chapter examines the regulatory oversight of Internet Exchange Points (IXPs), essential for global Internet infrastructure and traffic routing. Through a comparative analysis of telecom regulators in Russia, Brazil, and the US, this chapter identifies these agencies’ roles and responsibilities regarding IXPs. The chapter also explores the critical function IXPs serve within the Internet ecosystem, emphasizing their role in managing international Internet traffic. In Russia and Brazil, telecommunications regulators enforce compliance with national laws, impose sanctions on non-compliant IXP operators, and influence traffic routing and pricing. Differently, the US Federal Communications Commission (FCC) has a less defined role, primarily measuring broadband speeds. The chapter further examines Russia's Digital Sovereignty Law (90-FZ), Brazil's multi-stakeholder model led by ANATEL and CGI.br, and the FCC's limited regulatory role in the US. It concludes by comparing the effectiveness of these regulatory approaches in managing IXPs.
