A new frontier for AI use: the case of Latin America and Cloud data

Abstract:
This chapter reviews the regulation of cloud and artificial intelligence (AI) in Latin America using the framework of the region's digital agendas for technology development. Cloud and AI are competitive and interrelated sectors, with growing markets for telecom and cloud operators in the region. Latin America has a diverse, complex regulatory framework for privacy and data mining in all its formats when stored in the cloud. We explain the context for these digital regulatory policies and how they differ by country, statute, language, agency, industry, sector, and function. We note the policy overlaps, contradictions, gaps, and shortcomings in addressing AI challenges. AI holds immense potential but also tremendous uncertainty and risk to individuals and society. To date, a patchwork of regulatory and institutional approaches has emerged across the region, rather than a unified regulatory approach. AI's potential extends to government. AI could both help and hinder governments in strengthening democratic institutions. The chapter concludes with policy recommendations and questions for further research relevant to the Latin America region.
