Governing social conflict in mining-affected communities under resource nationalism: three international investment cases from the Andean region

Abstract: Resource nationalist (RN) governments and mining justice (MJ) movements are potential allies, even though they tend to focus on the outcomes of resource extraction at different scales: national and local, respectively. However, pressures emanating from the international investment regime appear to discourage these alliances. Instead, these pressures encourage RN governments to maintain an extractivist governance model for community relations, where authority over these matters is largely delegated to mining companies. The chapter explores this argument by examining three leading investment cases in the Andean region where social unrest has led to the cancelation of a mining project. Each case reveals how both RN and non-RN administrations respond to conflicting pressures, leading to an eventual breakdown in investor-state relations. The reasoning and compensation awards made by the tribunals in these cases raise further concern for MJ movements, in that they appear to challenge existing incentives for extractive firms to avoid risky, irresponsible, or abusive community relations strategies.
