Reinterpreting human rights responsibility in international cooperation

Abstract:
Unfolding a cooperative dimension of human rights protection requires a re-interpretation of human rights law. This chapter presents suggestions on how the European Convention on Human Rights (ECHR) could be interpreted in an evolutive way to better respond to challenges posed by international cooperation. It uncovers the role the general law of international responsibility should play in defining how states become responsible under human rights in their cooperative conduct. Then, it proposes to make sense of a certain collective character of human rights protection which could guide the interpretation of rights in relation to international cooperation. Moreover, rules of international law from outside the ECHR will be relevant for interpreting the demands of the Convention for international cooperation.
