Abstract:
A cooperative dimension of human rights protection plays out in human rights obligations binding states in their cooperative conduct. The content of such obligations depends on the context of international cooperation, the mode and degree of a state's involvement in effects upon individuals and the relevant rights concerned. This chapter maps out different layers and forms of human rights obligations which should form part of a more comprehensive framework on human rights responsibility in international cooperation under the European Convention on Human Rights. This includes reflections on the development of a human-rights-based complicity rule, the role of due diligence obligations in relation to cooperative conduct, and duties to cooperate in the protection of human rights.
