Abstract:
The European Court of Human Rights (ECtHR) explicitly deals with the conflictual relationship between human rights protection and international cooperation in its case law relating to international organizations (IOs). This chapter elucidates how this line of cases is characterized by the continuous search for an adequate balance between upholding human rights protection while allowing states to participate in cooperation under IOs, even where their activities have harmful effects for individuals. It reveals how this can play out in far-reaching obligations of states to ensure human rights protection within their interactions under the auspices of IOs. In other instances, the ECtHR's jurisprudence develops rather deferential approaches absolving states from responsibility under the European Convention on Human Rights in these contexts.
