The ECtHR's continuous review over international cooperation

Chapter 9 in An International Human Rights Law of Cooperation, 2025, pp 230-238 from Edward Elgar Publishing

Abstract: This chapter argues for a persistent need for the European Court of Human Rights (ECtHR) to reconsider and redefine the demands of human rights upon states in their cooperative conduct. This is illustrated with issues more recently decided or pending before the Court concerning information sharing amongst intelligence services, due diligence obligations within specific contexts of international cooperation, and litigation in relation to climate protection. These constellations illustrate that the question of what human rights demand of states in their international cooperation is all but settled and will continue to reach the ECtHR.
