Future airspace: the European regulatory approach

Abstract:
EU drones law represents an intricate field that hinges on the Basic Regulation from 2018 and includes both the delegated and implemented regulations of the European Commission (Reg. 2019/945 and Reg. 2019/947) and the soft-law activity of the European Aviation Security Agency (EASA) with its opinions, guidance materials, and technical standards. The so-called Drones Regulation (Reg. 2019/947) was implemented by the U-space regulatory package (Reg. 2021/664, Reg. 2021/665, and Reg. 2021/666), setting up a complex governance system for the future of airspace. The chapter provides an overview of both the regulatory strategy and governance model adopted by the EU institutions. The aim of this chapter is to focus on the main novelties in EU drones law on airspace connectivity, U-space services, data sharing (Reg. 2021/664), and information security (EC Implementing Regulation 2023/203), together with more recent rules on innovative air mobility services (IAS), innovative air mobility (IAM), and urban air mobility (UAM), such as VCA (i.e., VTOL-capable aircraft, also referred to as air taxis) operations as laid down by the European Commission with the new UAM regulative package from April 2024.
