Investment protection

Chapter 57 in Elgar Encyclopedia of International Sanctions, 2025, pp 200-203 from Edward Elgar Publishing
Abstract:
Over the past two years, international sanctions imposed by states have become an increasingly important consideration in the field of international investment protection, particularly when it comes to the sanctions adopted in response to Russia's invasion of Ukraine. The war in Ukraine has seen an unprecedented range of unilateral sanctions deployed by Ukraine's allies, including the European Union, Canada, the United Kingdom and the United States. These sanctions target not only the Russian government but also Russian individuals and companies. They include asset freezes, travel bans, restrictions on the import and export of certain goods, restrictions on banking services and arms embargoes. The intensity and scope of the sanctions are likely to affect the investment of foreign investors operating in the territory of the sanctioning states and raise questions about their legality under international investment agreements.
