Judicial review (European Union)

Chapter 58 in Elgar Encyclopedia of International Sanctions, 2025, pp 204-208 from Edward Elgar Publishing
Abstract:
This entry highlights the most salient aspects of the judicial review of international sanctions by the Court of Justice of the European Union (‘the Court’). While European Union treaties provide for a limited jurisdiction of the Court over Common Foreign Security Policy acts, the Court has interpreted its competence to review the legality of restrictive measures (sanctions) extensively. Restrictive measures can be challenged by applicants on numerous grounds of legality, the review of which has led to varying degrees of judicial scrutiny by the Court.
