The UN Focal Point and UN Office of the Ombudsperson

Chapter 71 in Elgar Encyclopedia of International Sanctions, 2025, pp 242-247 from Edward Elgar Publishing
Abstract:
The increased use of United Nations (UN) targeted sanctions has created profound accountability problems and a growing need to take seriously the human rights of those targeted. With domestic and regional courts challenging the implementation of UN sanctions on due process grounds, two global redress mechanisms for UN sanctions were created: the UN Focal Point and the UN Office of the Ombudsperson. Some analyses frame these redress mechanisms as incremental steps towards greater respect for human rights by the UN. This entry challenges that narrative, resituating these procedural reforms as ad hoc responses aimed at strengthening the UN Security Council in the face of legal and political critique and preserving the Council's post-9/11 extension of its unique UN Charter Chapter VII sanctions powers. Key challenges that will shape these forms of global redress in the years ahead are considered in closing.
