Abstract:
Sanctions in the fight against terrorism constitute an important part of global sanctions practices. The two most prominent counterterrorism sanctions mechanisms were created by the United Nations Security Council through its Resolutions 1267 and 1373 sanctions regimes. Gradually, a general, global and comprehensive counterterrorism sanctions mechanism targeting non-state actors evolved from these two regimes. Sanctions aimed at combating terrorism have been criticized and scrutinized in the past by international courts and bodies due to the lack of sufficient due process mechanisms and legal safeguards to protect the rights of targeted individuals and entities. Subsequently, important institutional changes have been made to these regimes in terms of listing and delisting procedures and notification of targeted individuals and entities. In addition to the United Nations (UN), states like the United States and the United Kingdom and international organizations such as the European Union regularly adopt counterterrorism sanctions that commonly reflect the two UN sanctions regimes.
