Abstract: To develop the doctrines and principles applicable to insurance contracts, the true nature of insurance contracts must be understood. To that end, there must be an adequate working definition. Insurance contracts are different from other types of contract and so they have attracted peculiar principles and doctrines to regulate the rights and obligations of the parties to insurance contracts, including how insurance contracts are defined, how insurance contracts are created and the disclosure required to be provided by the parties prior to the conclusion of the contract, how the benefit of insurance contracts are limited to those with an insurable interest, and the principles adopted for the interpretation of insurance contracts. This chapter will consider the legal implications of these principles and doctrines and how they are influenced by the very nature and definition of an insurance contract.
