Abstract: Economic efficiency is undoubtedly one of the most prominent driving forces underpinning commercial law reforms. Yet, economic efficiency alone cannot dictate the trajectory of law development; it must be weighed against other considerations. In recent years, sustainability and ecological imperatives have gained significant prominence, reshaping the priorities of reform agendas. This chapter critically discusses the implications of sustainability considerations on the future of commercial law reforms and the extent to which they can thrive alongside economic efficiency imperatives. It argues that these values are not fundamentally antagonistic and that new business models such as those embracing the circular economy may provide a way forward for commercial enterprises to achieve their economic goals in compliance with environmental actions. Supporting this transition will require commercial law reforms that actively integrate and reinforce these dual objectives.
