Abstract: This chapter comments on Article 53 of the Anti-Money Laundering Regulation (EU) 2024/1624, which addresses beneficial ownership (BO) determination through control, including control by other means. It elaborates indicia of control (veto rights, appointment powers, contractual arrangements) and evidentiary expectations. The commentary explains fallback tests when control and ownership coexist or are opaque.
