Territorial value sharing of renewable energies: critical analysis of the French mechanism introduced by the 2023 Law on Accelerating the Production of Renewable Energies

Abstract:
The French “APER” law of 2023 introduced a new concept into French energy law, the concept of territorial value sharing. Territorial value sharing is a way of improving the social acceptability of energy transition projects, which is essential if we are to achieve objectives in the fight against climate change. Even if it is not legally defined, the concept of territorial value sharing can still be considered as an objective and mechanisms aimed at ensuring a fair distribution of the economic and territorial value of a project between the various stakeholders in the host territory in order to guarantee the social acceptability of the project and individual and collective ownership of the energy transition objective. The aim of this chapter is to understand and analyse the French concept of “territorial value sharing” from a theoretical point of view, based on an in-depth analysis of the main legal provisions. This concept is undoubtedly useful because it means taking into account the multidimensionality of the problems of rejection or conflicts surrounding an energy project. The mechanisms introduced need to be rethought to be effective. There are three limitations: the lack of a systemic approach and reflection on the notion of territory; the contractual technique that remains an unthinkable way of translating the concept into legal terms; the usefulness of the energy justice approach to correct the vulnerabilities arising from the application of these mechanisms.
