Abstract: The chapter “Article 3: Prohibition of torture” concerns the prohibition of torture, inhuman and degrading treatment and punishment. Chapter 3 focuses on the negative obligation to refrain from ill-treatment and the positive obligation to prevent and protect individuals from being exposed to such treatment as well as the obligation to investigate and prosecute cases of alleged ill-treatment.
