Chapter 7 in The European Convention on Human Rights: Volume I, Substantive Rights, 2026, pp 333-352 from Edward Elgar Publishing

Abstract: “Article 7: No punishment without law” concerns the concepts of a “criminal offence under national and international law”, as well as the concepts of “guilty” and “penalty”. The chapter also looks into cases concerning the “nullum crimen, nulla poena sine lege” principles, the non-retroactivity of criminal law, statutory limitation periods and universal jurisdiction, as well as the derogatory clause in Article 7(2).
