Abstract:
In this second chapter on the law of obligations the emphasis is on non-contractual obligations. This is usually understood to cover the law of tort (delict in Roman law) and restitution or unjust enrichment (quasi-contract in Roman law). The regulae concerning the law of tort (delict) cover negligence, liability in respect of things and land, liability for the acts of others, abuse of the law, and consent and necessity as defences. Three further maxims act as the foundation for an introduction to the law of restitution or unjust enrichment.
