Abstract: In this chapter one is moving to a more abstract level: the emphasis is on legal classification and legal theorising. Various fundamental distinctions are discussed, namely: public and private law; the law of persons, things and actions; common law and equity; natural law (ius naturale) and the law of peoples (ius gentium); and natural law and positivism. These discussions lead on to a brief examination of the principal method and theories underpinning contemporary legal thinking.
