Chapter 5 in Principia Iuris, 2025, pp 87-103 from Edward Elgar Publishing

Abstract: This chapter examines some of the principal maxims that have inspired the development of modern public law and constitutional thinking. Walter Ullmann's descending versus ascending thesis of power is one basic theme, while the Roman concept of the corporation (universitas) is another. However, in the United Kingdom, it is the notion of the Crown that dominates. One question that is still of relevance today is whether a ruler (monarch, president or whatever) is above the law.
