Abstract:
The second sub-section within the Roman law of things is the law of obligations. Today obligations have been raised to the third generic category and thus have replaced the law of actions in the Gaius plan; it is a category concerned with rights in personam. This chapter, the first of two on obligations, focuses on the nature of an obligation and on one of the principal institutions within this class, namely the law of contract. Regulae about the legal nature of contract, freedom of contract, good faith, interpretation, consent, vitiating factors such as mistake, frustration, and debt and damages claims make up the substance of what is an introductory overview of this important area of law.
