Chapter 2 in Private International Law and Global Crises, 2026, pp 14-38 from Edward Elgar Publishing

Abstract: In times where turbulent tides expose legal responses that are unfit to deal with global crises, introspection about private international law's own contributions seems apposite. Against the more traditional view that situates the field on the ‘outskirts’ of global crises, this chapter explores the field's functions, revisiting their foundations. It demonstrates that private international law's ‘ways’ are, at times, constitutive of, as much as part of the response to tackle, global environmental, social, and economic crises. On the one hand, it highlights areas of dysfunctionality contributing to exacerbate the inequalities at the root of some of these crises, and on the other, it reveals what this different way of thinking about law brings to the table in the articulation of responses to global crises. Ultimately, this reflective exercise aims to nurture transformative thinking in a field that has, throughout history, facilitated alternative pathways. It suggests that the journey to profound change in our times requires not only strengthening the muscles of private international law to mitigate the adverse impact of crises, but an entire ‘workout’ to realise ambitious new imaginaries of the field's untapped potential to address global crises.
