International human rights standards and accountability of Kosovo

Abstract: This chapter discusses Kosovo's unique engagement with international human rights. On the one hand, the absence of Kosovo's full international recognition as an independent state prevents it from acceding to core international human rights treaties. On the other hand, its domestic legal framework is very progressive as it constitutionally incorporates and directly applies the most important international human rights treaties, including the European Convention on Human Rights. This chapter traces the development of this human rights system from the UN interim administration of Kosovo of 1999 to the 2008 Constitution, which requires that human rights are interpreted according to the case law of the European Court of Human Rights. Despite the application of human rights standards in domestic law, Kosovo's international legal accountability remains limited because it is not yet a member of the UN and the Council of Europe. While domestic bodies, such as the Constitutional Court and the Ombudsperson, provide domestic legal remedies, the lack of international judicial and other mechanisms leaves the human rights system incomplete and unsupervised.
