European sources of the morality patent exception

Chapter 1 in Morality in the Unitary Patent System, 2026, pp 2-27 from Edward Elgar Publishing

Abstract: To place the study and the method's design in context, it is necessary to begin by sketching the systemic and historical background for the morality exception. The study centres on the European Patent Convention and the EU Biotechnology Directive while also acknowledging the long history of morality dating back to early codifications of patent law on the continent. From a historical perspective, Chapter 1 retraces the legislative history of the exception and investigates its multistage journey from national statutes to harmonised sources of European patent law. A detailed study of documents reporting negotiations sheds new light on the provision's intended role in the patent system. It also reveals a complex network of political and institutional interdependencies, which had a profound impact on the provision's final wording.
