Abstract:
The closing chapter puts the designed theory into action and illustrates its operation through two related case studies, designed based on existing or soon-to-emerge technologies in biotechnology: One ‘standard’ and the other uniquely futuristic, yet both equally revolving around scientific attempts to revive extinct animal species. The first invention concerns in vitro embryo culturing, while the other is directed to the transgenic animals—a modern ‘proxy’ for the extinct species. The goal is to prove that the proposed method of interpretation is equally applicable to both scenarios, irrespective of how peculiar the subject-matter claimed appears. At the end, Chapter 9 revisits the role of patent authorities under the new theory and reassesses expectations we hold towards them. The aim is to determine whether supranational authorities, for whom the method was designed in the first place, are prepared to use it in resolving real cases.
