Abstract: This chapter examines the role of public procurement as a driver of innovation within the European Union (EU), analysing the limitations of Directive 2014/24/EU in fostering innovative solutions despite its introduction of the innovation partnership procedure. It identifies persistent barriers—such as risk aversion, legal uncertainty, and lack of expertise among contracting authorities—and critiques the underutilisation of innovation-focused procurement mechanisms. Drawing on recent EU strategies like the Draghi Report and the New European Innovation Agenda, the chapter proposes concrete reforms to align public procurement with the EU innovation-driven competitiveness goals. These reforms aim to align public procurement with the EU's innovation-driven competitiveness goals, addressing harmonisation challenges, and legal uncertainty.
