Chapter 9 in Parallel Framework Agreements in EU Public Procurement Law, 2026, pp 284-296 from Edward Elgar Publishing

Abstract: This chapter concludes the analysis of parallel framework agreements and reflects on their implications for EU public procurement law. It highlights that while parallel framework agreements respond to the practical needs of contracting authorities – enhancing flexibility, market access, and supply security – they also reveal significant gaps and inconsistencies in the current legal framework. The chapter summarises the key findings on the compatibility of parallel framework agreements with procurement principles, including transparency, equal treatment, and competition, as well as the limited protections for economic operators. It emphasises that existing rules inadequately address simultaneous procurements and the discretion exercised by contracting authorities, creating legal uncertainty. Drawing on these insights, the chapter argues for a revision of EU framework agreement regulation, proposing clearer rules on procurement obligations, methods for choosing between parallel agreements, and strengthened safeguards against anti-competitive practices. These reforms should aim to align law with current practices while ensuring transparency and effective market competition.
